All orders are accepted by The Ceramic Tile Warehouse subject to these conditions of sale, which supersede any previous conditions.

2: Definitions. Back to top

In these conditions unless the context requires otherwise the singular shall include the plural and the masculine gender the feminine and neuter genders and vice versa and the following words shall have the meanings set out opposite them:

(a) “we” and “us” means The Ceramic Tile Warehouse;

(b) “you” means any person, firm, company or organisation to whom we agree to sell the goods;

(c) “the goods” means the goods (and any parts thereof) the subject matter of the contract as described in these conditions and(if appropriate) on the face of our acknowledgement of order form;

(d) “the manufacturer” means the manufacturer of the goods. (e) “the contract” means the contract of sale created by our acceptance of your order.

Samples are supplied to enable you to judge the quality of the goods, but do not constitute a sale by sample.

4. Variations. Back to top

The goods are supplied within the manufacturers tolerance limits of size, texture and colour variations. Due to the manufacturing process tiles delivered may not be identical in shade to samples previously supplied. It is your responsibility to check goods supplied before fitting as no claim can be accepted once goods supplied have been fitted.

5. Comparison with Previous Orders. Back to top

Due to the manufacturing process of tiles and their batching we cannot guarantee to match shades of tiles supplied in previous orders.

6. Crazing on Ceramic Tiles. Back to top

Due to the manufacturing process of tiles we can give no guarantee against crazing.

7. Quotations and Prices. Back to top

(a) Prices quoted are those then current, are indicative only, and shall not be binding on us. You will be charged at the price ruling at the date of the order being placed.

(b) Packaging and postage or carriage will be charged in addition to the price of the goods.

8. Description not Contractual. Back to top

Any description of the goods provided by us is intended for information only. Such descriptions are believed to be correct and current but are not warranted, do not constitute a description of the goods, are not to be taken as representations and do not form part of any contract of sale.

9. Delivery. Back to top

(a) All goods supplied by us shall be delivered to the address as specified in your order or to one of our showrooms if requested by you. If delivered to your address the goods will be carried on a tail lift vehicle to the nearest point of hard standing. It is your responsibility to take the goods into your property.

(b) The date of delivery of goods forecast, if any, is approximate and made by us in good faith. While every effort will be made by us to deliver the goods within the stated period, time is not the essence of the contract between us in this respect and no delay shall entitle you to cancel your order or to refuse to accept delivery of the goods.

(c) If we are responsible for a failure to deliver the goods or liability is limited to the excess of the cost to you of equivalent goods to replace these not delivered.

(d) If you fail to take delivery of the Goods or fail to give us adequate instructions for delivery, we may charge for redelivering the goods.

(e) Delivery costs are dependent on post code and will be advised when you place your order. All tiles are delivered on shrink wrapped timber pallets.

(f) All tiles are delivered by a national haulage company across mainland Scotland. The standard delivery time is 5 working days from receipt of payment. You will be notified of your delivery date by the haulier.

(g) Subject to reasonable vehicular access being available we can deliver to any address in Mainland Scotland. Advise us of the delivery address including postcode when you order. You will have to sign for your delivery.

(h) We do not offer a returns policy. We offer a sample service to help you make the right choice.

10. Acceptance of Conditions. Back to top

Acceptance of the goods or payment for the goods by you to us shall of itself constitute an acceptance of these conditions where acceptance has not previously been communicated to us.

11. Force Majeure. Back to top

In the event that the manufacture or delivery of any of the goods is prevented or hindered directly or indirectly by fire, the elements, war, civil commotion, strikes or lock-outs, industrial dispute, shortage of fuel notwithstanding that we have taken all reasonable steps to procure the same, shortage of labour, break down or partial failure of vehicles, plant or machinery, acts, orders or regulations of Government, delay on the part of any independent sub-contractor or supplier, or any other cause whatsoever beyond our reasonable control then the time for delivery of the goods shall be extended for a reasonable period having regard to the effect of the delaying cause on the manufacture or delivery.

12. Warranties and Liability Back to top

(a) Any claim by you which is based on any defect in the quality or condition of the goods or their failure to correspond with specification shall (whether or not delivery is refused by you) be notified in writing to us within 2 days from the date of delivery. If delivery is not refused, and you do not notify us accordingly, you shall not be entitled to reject the goods and the Company shall have no liability in respect of such defect or failure, and you shall be bound to pay the price as if the goods had been delivered in accordance with the contract.

(b) Where any valid claim in respect of any of the goods which is based on any defect in the quality or condition of the goods or their failure to meet specification is notified to us in accordance with these conditions, we shall be entitled to replace the goods (or the part in question) free of charge or, at our sole discretion, refund to you the price of the goods (or a proportionate part of the price), but we shall have no further liability to you.

(c) Except in respect of death or personal injury caused by our negligence, we shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, for any consequential compensation whatsoever (and whether caused by the negligence of the us, our employees or agents or otherwise) which arise out of or in conjunction with the supply of the goods or their use or resale by you except as expressly provided in these conditions.

13. Risk. Back to top

(a) The risk in the goods supplied by us shall pass to you on delivery to the place of delivery and the nearest point of hard standing.

(b) If we are requested to leave the goods at the your property, the risk in the goods supplied by us will pass to you once off loaded by us, and the responsibility for securing these goods is yours.

14. Payment and Credit Card Security. Back to top

Payment is by debit or credit card basis with order by web site. We reserve the right to refuse any debit or credit card transactions. Your payments will be made to The Ceramic Tile Warehouse which will show on your Credit Card Statement. Credit Card details are taken via our secure server and are encrypted at point of entry. All on line payments are processed through Protx and your card details are not handled by any member of our staff. Credit Card Payment is taken at the time your order is processed.

15. Claims.Back to top

(a) Any claims relating to the condition of the goods on delivery and which would be apparent on visual inspection must be communicated within two days of delivery via our contact facility on the web-site.

(b) Subject to condition 14(a) after two days from delivery you will be deemed to have accepted the goods as having been supplied in good condition, and in accordance with you order.

(c) Any claim as to the condition of the Goods not apparent on visual inspection must be communicated in writing to us within one week of the date of delivery.

(d) Liability for the defective condition of any goods supplied will not exceed the contract value of the goods in respect of which the complaint is made.

(e) Notwithstanding condition 14(a) no claim may be made in respect of defective condition of the Goods once they have been used by fixing to the wall / floor or by any attempt to fix the same to the wall / floor.

16.Notice. Back to top

Any notice required to be given by either us or you to the other shall be deemed to be properly served if sent by prepaid registered letter posted to our Registered Office or such address as may from time to time be notified to the other and any notice served shall be deemed to have been served twenty-four hours after the time of posting and in proving such service it shall be sufficient to prove that the notice was properly addressed and posted.

The construction, validity and performance of this contract shall be governed by the Law of Scotland.

The Ceramic Tile Warehouse is the trading name of T.C.T.W. Limited having its Registered Office at Merchant House, Mitchelston Industrial Estate, Kirkcaldy KY1 3NJ.
